1. Provider identification
The PosupClock service (the “Service”) is operated by posup.com LLC, a limited liability company organized under the laws of the State of North Carolina (United States), with its registered address at Franklinton, North Carolina 27525, USA. You can contact us at legal@posup.app.
2. Acceptance of terms
By registering and using the Service you accept these Terms and Conditions, as well as the Privacy Policy, Cookie Policy and Refund Policy. If you do not agree, do not use the Service.
3. Description of the Service
PosupClock is an attendance-tracking software that records staff clock-in and clock-out, including facial recognition, geographic zones, schedule management and payroll reporting.
4. Registration and account
You are responsible for the accuracy of the data provided and for keeping your credentials confidential. You are responsible for all activity under your account.
5. Plans, pricing and payment
Plan prices are shown within the Service. Payments are processed through Stripe. By subscribing you authorize recurring billing for the chosen period (monthly, semi-annual or annual) until you cancel.
6. Free trial
The Service may offer a free trial period. When it ends, the selected plan applies unless previously cancelled.
7. Cancellation and refunds
You may cancel at any time. Refund terms are detailed in the Refund Policy.
8. Customer obligations regarding employee data
The customer is responsible for obtaining explicit consent from its employees for the processing of biometric data (facial recognition) and for complying with applicable labor and data-protection law. Such processing is governed by the Data Processing Agreement (DPA).
9. Acceptable use
You may not use the Service for unlawful purposes, to infringe third-party rights, or to attempt to compromise the platform's security.
10. Intellectual property
The Service, its software, trademarks and content belong to posup.com LLC or its licensors. No rights are granted other than use in accordance with these Terms.
11. Limitation of liability
The Service is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect damages, lost profits or data loss arising from use of the Service.
12. Changes
We may update these Terms. Changes will be posted on this page and, when material, notified by email.
13. Governing law and jurisdiction
These Terms are governed by the laws of the State of North Carolina and of the United States of America, subject to the competent courts of that state.
